IEBC Warns Voters Against Taking Photos or Videos Inside Polling Booths

The Independent Electoral and Boundaries Commission (IEBC) has warned voters against taking photos or recording videos inside polling booths during the upcoming by-elections, saying the practice is illegal and punishable by law.

In a public notice shared ahead of the May 14 and July 16 by-elections, the commission said the secrecy and sanctity of the vote must be protected at all times.

According to the notice, photography and video recording are strictly prohibited inside polling booths.

The commission cited Section 7(3)(e) of the Election Offences Act, No. 37 of 2016, which states that any person attending election proceedings who captures an image of a marked ballot without lawful excuse commits an offence.

The law particularly targets individuals taking such images for financial gain or to demonstrate allegiance to a political candidate or party.

“The secrecy and sanctity of the vote must be preserved at all times,” the notice states.

IEBC Set to Hold By-Elections

The IEBC announced that by-elections scheduled for Thursday, May 14, 2026, will take place in the following areas:

  • Emurua Dikirr Constituency in Narok County for the Member of National Assembly seat
  • Porro Ward in Samburu County for the Member of County Assembly seat
  • Endo Ward in Elgeyo/Marakwet County for the Member of County Assembly seat

The commission also confirmed that the by-election for Member of National Assembly for Ol Kalou Constituency in Nyandarua County will be held on Thursday, July 16, 2026.

Penalties for Breaking the Law

IEBC warned that anyone found guilty of the offence risks facing heavy penalties.

Under the law, offenders may face:

  • A fine of up to Ksh 1 million
  • Imprisonment for up to three years or both

The commission urged Kenyans to follow election laws and help maintain free, fair and credible elections.

The Institution Urges Responsible Participation

The electoral body also encouraged voters to avoid spreading misinformation during the election period and reminded citizens that their vote remains private.

The notice was shared under the hashtags #YourVoteYourFuture, #TalkWithIEBC and #StopFakeNews as part of voter awareness efforts ahead of the by-elections.
